HURPA Calls For Clarity On Building Control and Public Health Enforcement in Delta State

The Human Rights Pathfinders Association (HURPA) expresses deep concern over the growing ambiguity in the enforcement of building-related regulations across Delta State.

Reports from various communities indicate that Environmental Health Officers, acting under the Delta State Public Health Law, are increasingly involved in activities traditionally reserved for Urban and Regional Planning Authorities, including halting construction projects and sealing buildings under development.

While HURPA acknowledges the critical role of Environmental Health Officers in safeguarding public health and preventing environmental hazards, we emphasize that unchecked overlap of responsibilities among government agencies creates confusion, undermines professionalism, and exposes citizens to potential abuse.

This situation raises serious human rights concerns, particularly regarding the right to property, the right to livelihood, and protection from arbitrary administrative actions.

HURPA therefore calls on the Delta State Government to:

1. Clearly define and publish the operational boundaries between Environmental Health Officers and Urban Planning Authorities.
2. Establish inter-agency coordination frameworks to prevent duplication of functions.
3. Ensure that enforcement actions strictly comply with due process and legal mandates.
4. Sensitize the public on their rights and obligations under relevant laws.

A transparent and well-coordinated regulatory system is essential for sustainable development, investor confidence, and the protection of citizens’ rights.
